3. Proper Use and Clinical Guidance

5. Limitation of Liability
To the fullest extent permitted by applicable law, EnhDme-Pro and Kevin’s Caregiver Network, together with their owners, officers, employees, and agents, will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any personal injury, facility disruption, property damage, or other loss arising out of or relating to a product’s design, manufacture, condition, or use where such loss is attributable to the manufacturer or to use of the product contrary to its technical specifications, labeling, or intended commercial purpose. Our total cumulative liability for any claim arising out of or relating to a product or your commercial purchase will not exceed the amount actually paid to us for that product.
6. Exceptions
Nothing in this notice excludes or limits any liability that cannot be excluded or limited under applicable law, including liability arising from our own gross negligence or willful misconduct, or any statutory rights that cannot be waived. Some jurisdictions do not allow certain exclusions or limitations of liability, so some of the above may not apply to your facility, and you may have additional legal rights.
